Florida is a “no-fault” divorce state, which means that its residents do not need to allege a spouse’s wrongdoing as the cause of a divorce. In most cases, the grounds for ending a marriage are irreconcilable differences. However, the respective conduct of each spouse during the marriage may be considered by the court when it comes to dividing property and awarding alimony.
In determining custody arrangements, courts will look to the best interests of the child. Generally, this means dividing their time with each parent in a relatively even way as long as this is practically feasible and there are no issues of substance addiction or domestic abuse. Legal custody is also usually divided evenly between the former spouses when possible. This refers to the right to make important decisions regarding the child’s upbringing, such as those involving education, religion, and medical treatment.
