LGBT Marriage Rights in Fort Lauderdale Page Image If nothing else, the subject of same-sex marriage is controversial nationwide – not just in Florida. But as the premier legal expert about marriage, Alan Braverman, Esq., is pleased to talk about LGBT marriage rights in Fort Lauderdale. If you are a same-sex, LGBT couple that is looking to get married in the state of Florida, and you’re curious about the state of LGBT marriage rights in Fort Lauderdale, Alan Braverman, Esq., is pleased to give a helping hand.

LGBT Marriage Rights in Fort Lauderdale – Where Does It Stand?

LGBT marriage rights in Fort Lauderdale have existed since the January 6, 2015 ruling in the case of Brenner vs. Scott. In that case, the district courts in Florida found that the ban on same-sex marriage was, on its face, unconstitutional. From that day, to this, any person who attempts to prevent a same-sex couple from getting married – or who refuses to honor the couple as married, and therefore entitled to the spousal benefits contained therein – is, in fact, breaking the law.

But LGBT marriage rights in Fort Lauderdale aren’t as easy as simply saying “it’s unconstitutional to deny two people – whether straight or gay – the right to get married.” Same-sex marriage was legal in the South of Florida – specifically, in Miami-Dade County – even prior to the federal ban being lifted. And while the clear majority of Floridians either have no opinion or, per several polls, in favor of same-sex marriages, there are in fact several ways in which a same-sex married couple can find their rights violated.

For example, per The Sun-Sentinel, there is still a chance that people who work in legislative and judicial offices could deny a same-sex couple from getting married. However, because the state ban on same-sex marriage has been left on the books – despite the federal ban against it being there – it is unlikely to be repealed anytime soon.

In addition, per The Huffington Post, while there is no federal law on the books that prevents a same-sex couple from experiencing discrimination in matters of housing and the workplace. Also, there is no law in the state of Florida that currently provides any protection for gay people from getting fired from their jobs if, indeed, it comes out that they are gay.

With these sorts of vulnerabilities that exist for same-sex couples, it’s no wonder that LGBT people come to Alan Braverman, Esq., when they need to exercise their LGBT marriage rights in Fort Lauderdale.
