What are the Foreclosure Laws in Florida?

In Florida, the most common type of foreclosure is judicial. When such an action is initiated, the borrower has 20 days to respond to the complaint. The foreclosing party is required to publish notice of sale for two straight weeks at least five days before the sale. Under Florida law, however, courts have the power to halt foreclosure proceedings if mediation is underway.

Once the house is sold, the eviction process is part of the foreclosure action because the right to possession is included in the judgment. After a certificate of title is issued, the foreclosing party can file a motion for writ of possession. If the motion is granted, the writ is posted to the house and the occupants have 24 hours to move out of the premises.
